Conde Travel

The contracting of any service offered by the travel agency/tour operator GRUPO CONDE TRAVEL (hereinafter referred to as “THE AGENCY”) grants the user the status of client (hereinafter referred to as “THE CLIENT”), with immediate and full acceptance of the following TERMS AND CONDITIONS. Therefore, both THE CLIENT and THE AGENCY expressly agree to be bound by these clauses.

DEFINITION OF SERVICE

Services refer to the logistical and operative management of excursions and tours that include: transportation, lodging, food, access tickets, sale of handicrafts, sale of airline tickets, equipment rental, among other related services, offered directly and/or on THE AGENCY’S website.

DEFINITION OF THE CLIENT

Any natural or legal person who contracts any service through any of the physical (in person) or digital (website) platforms of THE AGENCY.

In the event that the customer is a minor (under 18 years of age), they must possess and present prior legal authorization of their parents, guardians or legal representatives, who will be considered for all purposes responsible for the acts and expenses incurred by such minors in their care, declining THE AGENCY otherwise, any liability in this regard.

DEFINITION OF THE AGENCY

THE AGENCY is a company registered in Cusco, Peru under the status of travel agency and tourism – a tour operator that offers tourist services nationwide under the name of GRUPO CONDE TRAVEL SAC and registered with the RUC N° 20609343185.

NOTE

THE AGENCY reserves the right to modify or update the aforementioned clauses at any time, without prior notice to users, and without prejudice to THE AGENCY. THE AGENCY may also establish Special Conditions for the regulation of certain services. These changes will become effective immediately upon being posted on the website or any of its associated platforms.

TERMS OF SERVICE

THE AGENCY provides tourist services in Peru (a developing region) and therefore the services may NOT correspond to what you normally consider or are used to.

However, we partner with the best local service providers in the cities, towns, and villages where our services operate. Traveling in Peru requires flexibility, patience, and a good sense of humor to accept and adapt to unexpected situations beyond our control. (Force Majeure).

FORCE MAJEURE

This act can be defined as any event that THE AGENCY cannot avoid, despite expending the greatest effort and / or all possible options. This encompasses events and/or catastrophes such as wars or threats thereof, riots, protests (of any kind), epidemics and pandemics (of any kind), natural disasters (of any kind), adverse weather conditions, fires (of any kind) or similar external events that are beyond control.

In this case THE AGENCY shall not be responsible for such events and reserves the right to modify, postpone or even cancel THE CUSTOMER’S trip (of course, this being the final option).

In case of strikes, protests, stoppages, etc. or other force majeure events, we may have to alter the starting date earlier or later than originally scheduled and / or perform the service in less time, modifying the service without prejudice to THE AGENCY.

The times shown in the itineraries are approximate and serve only as general guidelines. Some itineraries of our services may start in the early morning hours (around 3 a.m.) in order to complete the tour during the day (avoidance of extreme weather conditions or unforeseen situations).

On some occasions THE AGENCY may need to endorse or transfer THE CLIENT to another tour service provider, primarily in circumstances involving force majeure, thus ensuring the safety and comfort of the service.

It is the responsibility of THE CUSTOMER to arrive at the date and time indicated for the start of any of the contracted services.  Arriving late may be considered a “no-show”, in which case we will not be responsible for the annulment, cancellation and/or loss of the contracted resources and services.

NO SHOW

Refers to the situation in which THE CLIENT, after making a reservation with THE AGENCY, does not show up or arrives too late at the beginning of the service, resulting in missing the departure of the transportation service (bus, plane, boat, etc.).

The aforementioned circumstance likewise applies if THE CUSTOMER is not in possession of the required documents, namely a passport, an accommodation voucher, or any other document proving that they are THE CUSTOMER of any of the services provided by THE AGENCY or its suppliers.

RESERVATIONS

Any reservation of our services requires a request either through the website or via e-mail and an advance payment of 40% corresponding to the value of the requested service. We do not accept or process reservations via phone call or WhatsApp. All reservations are made directly between THE CLIENT and a representative of THE AGENCY.

We will only accept reservations received within the minimum time of anticipation according to the description and requirement of the service offered by THE AGENCY. Furthermore, the sending of THE CLIENT’S data does not constitute a reservation and does not automatically confirm the service.

BOOKING CONFIRMATION

The AGENCY will confirm any reservation via e-mail once it has validated the receipt of the advance payment from THE CUSTOMER and confirmed the start date of the requested service. Otherwise, THE AGENCY reserves the right to reject or cancel the reservation request.

Note: The services booked by THE CLIENT, including entrance to Machu Picchu, train tickets, and flight tickets, are non-refundable and cannot be changed, cancelled, or modified once the reservation is confirmed and an advance payment has been made. These services are regulated by government entities such as the Dirección Desconcentrada de Cultura (Ministry of Culture) and private companies like PERU RAIL and INCA RAIL, which do not permit any modifications or cancellations.

If it is possible to modify plane tickets, train tickets, or similar bookings, these changes must be processed through the respective entities and may incur additional service fees from THE AGENCY, as these modifications often involve penalties from the service providers.

PRICES

The prices of the services offered by THE AGENCY are expressed in US dollars and therefore THE CUSTOMER must pay the agreed-upon amount for the requested service in the currency specified.

Our service prices are set per person based on group arrangements. This means the cost covers lodging, transportation, food, and guiding as part of a group or with at least one other person. For services like lodging, this includes shared rooms or tents. Private service requests can be accommodated for an additional fee determined by THE AGENCY.

PAYMENTS

All payments include the commissions which are imposed by THE AGENCY, banks, payment platforms, and other entities. These commissions will be based on the projections and calculations established for each service or resource provided by THE AGENCY.

PAYMENT METHODS

THE CLIENT can make a payment through any of the online platforms offered by THE AGENCY. The primary methods for payment and money transfer include Bank Transfer, Western Union, and Credit/Debit Card (Visa, MasterCard, American Express, etc.). Additionally, payments can be made via bank deposit and cash.

THE CLIENT may pay in their local currency using the described payment methods, with the amount converted to dollars as specified.

The CLIENT can only pay in cash using dollars. Payments in Euros or Soles (Peruvian currency) are also accepted, but THE AGENCY will convert them to dollars based on the exchange rate at the time of the payment request.

It is also understood that any variation in the prices of services, taxes, fees and/or currency exchange rates will result in a revision of the final price.

ADVANCE PAYMENT

It refers to the amount of money that THE AGENCY requests as a guarantee, being 40% of the total cost of any service THE CLIENT requests.

To initiate the reservation process and subsequently its confirmation THE AGENCY must receive, at minimum, the advance payment from THE CLIENT as well as the immediate communication of payment via telephone or e-mail.

The advance payment of a reservation enables us to secure permits, tickets, hotels, and trains, on behalf of THE CLIENT, thereby ensuring an optimal service.

BALANCE PAYMENT

The CUSTOMER must settle the outstanding balance no later than 48 hours before the start of the contracted service. If advance payment is not possible, the CLIENT must pay immediately upon arrival in Peru, either in cash or by credit/debit card (with a 6% commission applied to the total amount). Any commissions on the advance or final payment must be fully covered by THE CUSTOMER and are not included in the price of the requested service.

You can make the payments in cash (without commission); in person, this is conducted through an authorized agent since under this modality the payments do not require additional commission, although they are also subject to taxes of law.

We reserve the right to cancel your trip if you do not make the balance payment within the established timeframe.

CANCELLATIONS

Unfortunately, all advance or guarantee payments (including commissions) made by THE CLIENT are 100% NON-refundable and 100% NON-transferable.  

Once THE CUSTOMER has paid the outstanding balance of payment (including commissions), it is NOT possible to refund or transfer the payment for cancellations of any nature. However, there remains the option of providing the respective tickets (entrance to tourist attractions and train), purchased already in the name of THE CLIENT.
